Statutory Information Disclosure (ECTA s43)
1. Electronic Contracting & Consent
These Terms of Service constitute a legally binding agreement between you ("User", "Buyer", or "Agent") and GM Farming (Pty) Ltd (trading as webuyveg.com and Farmazone Trading). By accessing, browsing, registering an account, or placing an order on our platform, you expressly consent to electronic contracting in accordance with Section 13 of the Electronic Communications and Transactions Act 25 of 2002 (ECTA).
2. Platform Marketplace Model
Farmazone Trading operates an agricultural e-commerce platform connecting produce suppliers, local farmers, Community Agents, and buyers across South Africa. We facilitate direct farm-to-door fresh vegetable delivery, bulk produce sales, and veg box subscriptions.
3. Payment Methods & Financial Settlement
The platform accepts payments through authorized payment channels set by the platform configuration:
- Pay@ Online & Retail Store Gateway: Enables Card, Instant EFT, SnapScan, and 14-digit retail till barcode payments at major retailers across South Africa, including Pick n Pay, Shoprite, Pep, and Spar. Retail till cash/card payments generate instant webhooks to authorize order processing.
- Direct Bank EFT Transfer: Buyers may transfer funds directly into our corporate bank account. Orders are released upon verification of uploaded Proof of Payment (POP) or bank clearance.
- Farmazone Pre-Funded Wallet: Registered Community Agents and buyers may pre-fund their digital wallet balance for instant single-click order checkout. Wallet balances are non-interest bearing.
4. Limitation of Liability & Force Majeure
To the maximum extent permitted by Section 61 of the Consumer Protection Act 68 of 2008 (CPA):
- Farmazone Trading shall not be liable for agricultural force majeure events outside our reasonable control, including extreme weather events, crop disease outbreaks, severe drought, municipal loadshedding affecting regional cold storage, or road closures.
- Our total aggregate financial liability for any failed, defective, or delayed order shall be strictly capped at the total purchase price paid for that specific order.
5. Governing Law & Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the Republic of South Africa. Any legal dispute arising out of or in connection with these Terms shall be submitted to the non-exclusive jurisdiction of the High Court of South Africa (KwaZulu-Natal Division, Pietermaritzburg / Durban).
